General Terms and Conditions (GTC) of Harrisons.ch

SCOPE

For the use of this website as well as the business relations between www.harrisons.ch and its customers, the following General Terms and Conditions (GTC) apply in the version currently available and valid when accessing the website or ordering goods. The offer on this website is aimed exclusively at customers with Swiss residence.

A customer is any natural or legal person who maintains business relations with www.harrisons.ch. The General Terms and Conditions, the Terms of Delivery and Payment as well as the Privacy Policy may be amended from time to time. www.harrisons.ch asks you to read these provisions carefully each time you visit the website and order goods.

These GTC apply exclusively. Conflicting, supplementary or deviating terms and conditions require the express written confirmation by www.harrisons.ch in order to be valid. When using this website or ordering goods, the customer confirms to fully accept these GTC, including terms of delivery and payment.

Should individual provisions of these GTC prove to be invalid or unenforceable or become ineffective or unenforceable, this shall not affect the validity of the remaining provisions.

All information on www.harrisons.ch (product descriptions, illustrations, films, dimensions, weights, technical specifications, accessory relationships and other information) are to be understood only as approximate values and in particular do not represent any assurance of properties or guarantees, unless explicitly stated otherwise. www.harrisons.ch makes every effort to provide all details and information on this website in a correct, complete, up-to-date and clear manner, but www.harrisons.ch cannot expressly or implicitly guarantee this.

All offers on this website are subject to change and are not to be understood as a binding offer.

PRICES

Unless otherwise stated, the prices quoted by www.harrisons.ch include the statutory value added tax, any advance recycling fees (VRG) and copyright levies for electronic devices. The prices are strictly net in Swiss francs (CHF).

Unless otherwise provided, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the ordering process.

Technical changes, errors and misprints are reserved, in particular www.harrisons.ch can make price changes at any time and without prior notice. The sales prices do not include consulting and support services

CONCLUSION

The offers on this website represent a non-binding invitation to the customer to order products and/or services from www.harrisons.ch. By placing an order via this website, including the acceptance of these GTC, the customer submits a legally binding offer to conclude a contract. www.harrisons.ch then sends an automatic “order confirmation” by email, which confirms that the customer’s offer has been received by www.harrisons.ch. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.

The contract is concluded as soon as www.harrisons.ch sends a declaration of acceptance by email, confirming the dispatch of the ordered products or services.

Orders will only be delivered after full receipt of payment (exception: delivery against invoice) and if the goods are available. If, after conclusion of the contract, it becomes apparent that the ordered goods cannot be delivered or cannot be delivered in full, www.harrisons.ch is entitled to withdraw from the entire contract or from a part of the contract. If the customer’s payment has already been received by www.harrisons.ch, the payment will be refunded to the customer. If no payment has yet been made, the customer is released from the payment obligation. www.harrisons.ch is not obliged to make a replacement delivery in the event of termination of the contract.

PAYMENT OPTION AND RETENTION OF TITLE

The payment options specified in the order process are available to the customer.

www.harrisons.ch reserves the right to exclude customers from individual payment options without giving reasons or to insist on prepayment.

www.harrisons.ch may charge default interest of 5% per year as well as a reminder fee of a maximum of CHF 20.- per reminder in the event of default of payment by the customer.

The products delivered to the customer remain the property of www.harrisons.ch until full payment.

DELIVERY, OBLIGATION TO INSPECT, NOTIFICATION OF DEFECTS AND RETURN

The deliveries will be sent by post or courier service to the address indicated by the customer in the order. Invoices are issued by email or by post. Upon dispatch, benefit and risk shall pass to the customer, insofar as this is legally permissible.

If the delivery is not deliverable or if the customer refuses to accept the delivery, www.harrisons.ch can dissolve the contract after a notification of complaint by email to the customer and setting a reasonable deadline and invoice the costs for the activities.

The customer is obliged to inspect the delivered goods immediately after receipt of the delivery and to notify any defects for which www.harrisons.ch warranty immediately in writing by email to the address in the (>imprint).

Returns to www.harrisons.ch are made at the expense and risk of the customer. The customer must send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects to the return address specified by www.harrisons.ch in the (>imprint).

If the inspection by www.harrisons.ch reveals that the goods do not have any detectable defects or that they are not covered by the manufacturer’s warranty, www.harrisons.ch may charge the customer for the activities, the return or any disposal.

WITHDRAWAL

The customer is granted a right of withdrawal for 10 calendar days after receipt of the goods. The deadline shall be deemed to have been met if the customer sends the written revocation by email (info@prince-tailors.ch) to www.harrisons.ch within the deadline. The revocation does not require any justification.

The exercise of the right of withdrawal leads to a rescission of the contract. The customer must return the goods within 10 calendar days in their original packaging, complete with all accessories and together with the delivery note to the return address specified by www.harrisons.ch in the (>imprint). Returns to www.harrisons.ch are made at the expense and risk of the customer. Any payment already made will be refunded to the customer within 20 calendar days, provided that www.harrisons.ch has already received the goods back or the customer can provide proof of dispatch.

www.harrisons.ch reserves the right to demand appropriate compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the reduction in value from the purchase price already paid or to invoice the customer.

No right of withdrawal is granted in the following cases:

  1. If the contract has a random element, namely because the price is subject to fluctuations over which the provider has no influence.

  2. If the subject matter of the contract is a movable item which, due to its nature, is not suitable for return or can spoil quickly;

  3. If the subject matter of the contract is a movable item that is made according to the consumer’s specifications or is clearly tailored to personal needs;

  4. If the subject matter of the contract is digital content and this content is not made available on a fixed medium or if the contract is to be performed in full immediately by both parties;

  5. If the subject matter of the contract is a service and the contract must be fully performed by the provider with the prior express consent of the consumer before the withdrawal period has expired.

  6. In the areas of accommodation, transport, delivery of food and beverages and leisure activities, if the provider undertakes, at the time of conclusion of the contract, to provide the services at a specific time or within a specified period of time.

WARRANTY

www.harrisons.ch strives to deliver goods of impeccable quality. In the case of defects notified in good time, www.harrisons.ch assumes the warranty for freedom from defects and functionality of the item purchased by the customer during the statutory warranty period of usually two years from the date of delivery. It is at the discretion of www.harrisons.ch to provide the warranty by free repair, equivalent replacement or by refund of the purchase price. Further claims are excluded.

The warranty does not cover normal wear and tear as well as the consequences of improper handling or damage by the customer or third parties as well as defects attributable to external circumstances. Likewise, the warranty for consumables and wear parts (e.g. batteries, rechargeable batteries, etc.) is excluded.

www.harrisons.ch it is not possible to give assurances or guarantees for the topicality, completeness and correctness of the data as well as for the constant or undisturbed availability of the website, its functionalities, integrated hyperlinks and other content. In particular, it is neither warranted nor guaranteed that the use of the website will not infringe the rights of third parties who are not owned by www.harrisons.ch.

LIABILITY

www.harrisons.ch excludes any liability, regardless of its legal basis, as well as claims for damages against www.harrisons.ch and any auxiliary persons and vicarious agents. In particular, www.harrisons.ch shall not be liable for indirect damages and consequential damages, loss of profit or other personal injury, property damage or pure financial loss of the customer. Further mandatory statutory liability is reserved, for example for gross negligence or unlawful intent.

www.harrisons.ch uses hyperlinks only for the customer’s simplified access to other websites. www.harrisons.ch can neither know the content of these web offers in detail, nor assume liability or other responsibility for the content of these websites

PRIVACY

www.harrisons.ch may process and use the data recorded in the context of the conclusion of the contract to fulfil the obligations arising from the purchase contract and use it for marketing purposes. The data necessary for the performance of services may also be passed on to commissioned service partners (logistics partners) or other third parties.

OTHER PROVISIONS

www.harrisons.ch expressly reserves the right to change these GTC at any time and to bring them into force without notice.

In the event of disputes, Swiss substantive law shall apply exclusively, to the exclusion of conflict of law provisions. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.

The place of jurisdiction is Fribourg, unless the law provides for mandatory places of jurisdiction.
